Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day of the conclusion of the contract.
To exercise the right of withdrawal, you must inform us magicGerman Britta Friedrich, Ul. Zakopiańska 29, 34-700 Rabka-Zdrój, Poland (britta@magicGerman.net) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated us your withdrawal from this contract, in comparison with the full coverage of the contract.
Additional information for short-term bookingsIf you expressly consent to the execution of the lesson before the withdrawal period has expired, the right of withdrawal expires with the beginning of the execution of the lesson.

Terms & Conditions
§ 1. General
1. The following terms and conditions are part of all contracts between magicGerman Britta Friedrich (referred to as “magicGerman” or “we”) and the customers. The following conditions apply exclusively to all initial, current and future transactions to be concluded with magicGerman.
§ 2 Subject of the Contract
magicGerman provides training (German language, culture, business culture within a 1-1 or group setting or as self-learning programs). 1-1 and group training is provided via Zoom and may or may not include online course material. For details of what the training includes and how it is conducted, please refer to the detailed description on the course site.
Subject of Changes: Trainings
We are entitled to make necessary changes in content, methodology and organization or deviations before or during the event, provided that these do not significantly change the benefit of the announced event for the participant. We are entitled to replace the designated teacher/trainer if necessary (e.g. illness, accident) by another person who is equally qualified with regard to the announced topic.
Subject of Changes: Online Course Content
We expressly reserve the right to change, supplement or delete parts or all of the content of the online courses, as well as the platform, or to temporarily or permanently discontinue the provision.
We strive to provide permanent access to the online course content. However, availability at all times is expressly not guaranteed. In particular, access may be temporarily restricted for technical reasons, such as necessary maintenance and repair work.
§ 3 Registration
All students need to be of legal age or under the supervision of a parent or legal guardian who agrees to be bound by these Terms. You represent and warrant that you are at least 18 years of age (the age of legal majority under applicable law), or, if not, that you have reviewed these Terms with your parent or legal guardian and that he or she has agreed to be bound by these Terms.
Please register/book online via our website or in writing using the registration forms prepared for you. If you do not use the shopping cart on our website or the forms prepared by us, please provide us with the name of the participant and the full company address or billing address with telephone number as well as email address. Your registration is binding and will be booked by us in the order in which it is received. If the event is already fully booked, we will contact you immediately, otherwise we will send you your registration confirmation.
Credits and packages for 1-1 training or coaching are valid as advertised on the product website. If there is no validity on the product site, the service is valid for 12 months after purchase. After that, the unused credits will be lost, and the client will not be reimbursed.
§ 4 Price
The prices stated on the course site and in the online shop on the booking date apply. All prices are final prices but do not include fees or interest charged by the client’s bank, credit card or payment provider. These charges are the sole responsibility of the client. According to Polish tax law, magicGerman is VAT exempt, and therefore the prices do not include VAT.
We usually charge the participation fees immediately after registration. Invoices are sent via email. The prices stated on the website are non-binding.
The various discount options we offer cannot be combined.
If you partially cancel later, the above-mentioned discount may be withdrawn.

§ 5 Cancellation Policy
E-Learning Offers / Self-learning Online Courses / Memberships
Due to the nature of the products being instantly available, we cannot offer refunds. Please use the trial options to determine whether or not the product is right for you before making a purchase. If you have questions about the product before purchasing, please contact us at letstalk@magicGerman.net.
1-1 Training or Coaching
Rescheduling: You may reschedule once up to 24 hours before the booked appointment. You can do so on the My Lessons page. If you encounter problems please contact order@magicGerman.net.
Cancellation: You can cancel appointments at any time. You can do so on the My Lessons page (if you encounter problems please contact order@magicGerman.net.).
Please note that we charge the following processing fees:
Cancellation up to 48 hours before the appointment: We will reimburse the full amount minus the processing fees of our payment provider and an admin fee. If the lesson is part of a lesson package, the package discounts will be withdrawn. Already taken lessons will be charged at full price and only the difference minus fees (processing fees of our payment provider and admin fee) will be reimbursed.
Cancellation from 48 hours before the start of the event: The full participation fee will be charged. This also applies if you do not appear or the lesson had been rescheduled previously.
§ 6 Cancellation of Events
We reserve the right to cancel the event due to reasons for which we are not responsible (e.g. sudden illness of the trainer, force majeure, etc.). Liability and damage claims are excluded unless we have acted with intent or gross negligence.

We reserve the right to cancel the event due to insufficient demand or number of participants or for other important reasons for which we are not responsible (e.g. sudden illness of the trainer, force majeure). Participation fees already paid by you will of course be reimbursed. Further liability and damage claims are excluded, unless we have acted with intent or gross negligence.
§ 7 Liability for and Use of Material provided
The documents made available as part of the training are created to the best of our knowledge. Liability and guarantee for the correctness, topicality, completeness and quality of the content are excluded.
Use of Teaching Material
Disclosure to third parties or to public distribution, or making course documents or teaching materials available is not permitted. In particular, the publication of audio or video data, digital presentations or scripts in publicly accessible internet portals (sharing) is prohibited.
Use of online courses
We give each participant personal access. The use of the online course is limited to this participant and for a certain period. Passing on the access data to third parties is not permitted.
§ 8 Confidentiality
The relationship of trust between all parties involved requires strict confidentiality. We therefore treat all information, data or documents that belong to our client or the associated company as confidential and / or proprietary, regardless of whether they are written or oral. This includes, but is not limited to ideas, concepts, methods, etc. In particular, we commit ourselves to never sell, trade, publish, reproduce, or otherwise disclose such Confidential Information to any person or company without first obtaining written confirmation from the user and the company.
The above obligations are not applicable to information which:
- is already in the public domain or becomes accessible to the public through channels other than an act or an omission on our part;
- must be published in accordance with the law, official order, or court decision.
The obligation to maintain confidentiality also applies after the training has ended. Cases in which there are legal obligations with regard to the exchange of information or in which we are explicitly released from the user’s or the company’s obligation to maintain confidentiality are excluded from this regulation.
As soon as the purpose for which the Confidential Information has been acquired has been achieved, we will immediately return or destroy all originals and copies of the Confidential Information.
§ 9 Title Retention
We reserve the unrestricted ownership of all deliveries of teaching materials until the customer has fully met all payment obligations.
§ 10 Trademarks
magicGerman, our logo, and any other product or service name or slogan displayed on our services are trademarks of magicGerman Britta Friedrich and may not be copied, imitated or used, in whole or in part, without the prior written permission of magicGerman or the applicable trademark holder.
§ 11 Feedback
By submitting any Feedback, you agree that your disclosure is gratuitous, unsolicited and without restriction and will not place us under any fiduciary or other obligation, and that we are free to use the Feedback without any compensation to you, and/or to disclose the Feedback on a non-confidential basis or otherwise to anyone. You agree that we may, in our sole discretion, use the Feedback you provide to us in any way, including in future enhancements and modifications to our Services. You hereby grant to us and our assigns a perpetual, worldwide, fully transferable, sublicensable, irrevocable, royalty-free license to use, reproduce, modify, create derivative works from, distribute, and display the Feedback in any manner and for any purpose without any obligation to provide attribution or compensation to you or any third party.
§ 12 Disclaimer
1. magicGerman is not liable for the uninterrupted accessibility of the website.
2. The offers of magicGerman on the website are subject to change.
3. magicGerman assumes no liability for the currentness of data, legal validity, completeness or quality of the information provided. Liability claims against magicGerman, which refer to material or immaterial damage caused by the use or non-use of the information provided or by the use of incorrect and incomplete information, are fundamentally excluded, unless magicGerman is proven intentional or there is gross negligence.
4. Any claims for damages by the client resulting from the service offered by magicGerman, although for whatever legal reason, are generally limited to the amount of the invoice.
5. The online courses are delivered in their original state and in the current version. magicGerman generally accepts no liability whatsoever for functionality, suitability for a specific purpose or other claims for damage or compensation arising from the use.
§ 13 Data Protection
§ 14 Place of Performance and Jurisdiction
Wrocław is agreed as the place of performance and jurisdiction for all deliveries. The law of the Republic of Poland applies.
If a dispute arises between the client and magicGerman, we aim to resolve such a dispute quickly and cost-effectively. Accordingly, before resorting to the alternatives stated below, you agree to first contact us directly to seek a resolution of your dispute at letstalk@magicGerman.net.
All claims are to be asserted against magicGerman within 30 days after the training in text form. Otherwise the claims are forfeited.
§ 15 Effectiveness
Our failure to enforce any right or provision in these Terms will not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing. In the event that a court of competent jurisdiction finds any provision of these Terms to be illegal, invalid, or unenforceable, the remaining provisions will remain in full force and effect.
